A student marries a prosector and the prosecution is forced to drop her sexual assault charges against a teacher.

Missouri teacher who is accused of sexually assaulting student can't be prosecuted because her husband is the victim.

Baylee A. Turner (26), a teacher at Sarcoxie High School was arrested in February 2019. She allegedly had sex after having sex with one her male students.

According to the Joplin Globe Turner was in her second year of teaching at the school after having taught for two years in the middle school. Turner was also accused of sleeping with a student in the week of January 14-21.

She resigned and the Sarcoxie School Board decided to petition the state to revoke her teaching licence, which she later gave up.

According to Nate Dally (assistant prosecutor in this case), Turner has since married the unnamed student, making it extremely difficult for her to be tried.

The Globe was informed by him that marital or spousal privilege is now in effect, so her ex-student and husband can't be forced to testify against her. They have therefore decided to drop the charges.

Although the probable-cause affidavit didn't reveal the student’s age, state law prohibits any sexual contact between school employees and students regardless of their age.

Dally didn't disclose the date of their marriage. Since then, the couple has moved out of state.

After Turner was released on $10k bond, she was ordered to avoid any contact with anyone under the age of 16. If convicted, Turner could face up to four years in prison.

According to the Globe Turner is one of six students who were accused in recent years of having sexual relations with a student.

This case recalls Mary Kay Letourneau who was convicted in 1997 of second-degree child rape after having a relationship with Vili Fualaau, then 12 years old. While she waited for sentencing, she gave birth to one of his children and his second while in jail.

They were married one year after their release in 2004. They remained together for 14 years before they split in 2019. Letourneau, 58, died from cancer in July 2020.
