The family of the man who tased the deputy has requested "criminal prosecution and termination" for the deputy. However, the DA declined to press charges.
Both the authorities and family of the victim have released the bodycam footage that shows the events leading up to the death of Brent Thompson, 28.
According The Larimer County Sheriff's Office Thompson, 28 was stopped by Larimer County Sheriff's Office on February 18 for driving a car with an expired registration.
The video was shared this week with the public. Thompson, who claimed he didn't have a driver's license on him, first identified himself as Jacob Jones before the authorities realized that he gave the wrong name.
The footage below, while it does not show the exact moment of impact is still disturbing to watch.
Thompson, who was called "Brent" by the officers, fled from them, running down a side street and onto the interstate. Lujan, who was on foot pursuing Thompson, shouted at him to stop and warned him that he'd be tased. Lujan used his taser to knock Thompson down after he jumped over the barricade at the I-25. The video released by Sheriff's Office shows a car speeding towards Thompson's motionless body as Lujan yells "S ---,, s ---!"
The longer version of the video, released by NBC, shows Thompson handcuffed and pulled off the road after he had been run over. He was then given CPR.
The Sheriff's Office said that a Taser had been used to try and stop him from endangering innocent drivers. "Unfortunately Mr. Thompson was hit by a passing car." Despite the efforts of deputies and EMS staff to save his life, he was pronounced dead at the hospital.
concluded that no criminal charges will be brought against Lujan. In his report, DA Gordon McLaughlin stated that while the outcome of this decision is tragic, the use of a taser to stop Thompson crossing the highway was the only force he could use.
McLaughlin said that Lujan's failure to "fully assess the imminent danger of oncoming highway traffic" was also a "clear lapse in judgement."
The DA said that the deputy had "used poor and ultimately a tagic judgement" when he deployed the taser on Thompson after he was already in the street, but he also believed the split-second decisions "were not made with malicious intent."
According to the Washington Post, he has been cleared to resume patrol.
Thompson's family wants Lujan "criminally prosecuted and terminated" and plans to sue him in civil court. His father told NBC that "this man took responsibility for pulling the trigger and incapacitating my kid for five seconds." "Look downstream, there's an approaching car!"
