On October 2, 2022, a 21-year-old Black male rented an Airbnb in San Jose. He was walking to the grocery shop when he was allegedly gunned down by Mark Waters, a neighbor.

A release from County of Santa Clara DA states that the victim saw Waters leave a house and approached him with a gun in his hand. According to the release, the victim tried to run for safety but Waters shot him when his back was turned. Waters fired one shot, causing serious injuries to the victim's right leg.
According to a police report, victim had a fractured femur. Waters called 9-1-1.
A neighbor obtained video of the incident, and Waters was later arrested and charged with felony assault using a semi-automatic weapon resulting in great bodily harm and personal use.
According to reports, eight firearms were also taken from the victim's home.
According to the DA, law enforcement is looking into hate crime allegations. He also stated that "everyone should feel safe walking to the shop." We won't tolerate any senseless or violent acts in this County. We wish the victim a quick recovery and will ensure that he is brought to justice for his brutal attack.
Waters and his lawyer have so far declined to comment. According to police reports, the suspect claimed that he believed the victim had a gun... but later realized that it was a pair headphones. Airbnb's rep released the following statement in response: "We condemn this vicious, unprovoked attack. They also sent a clear message that hate crimes do not belong in our society.
His arraignment is set for Monday, December 12.
