Is This Amendment a Disqualification for Her?
A 211-year-old constitutional change could prevent the duchess from running for president. Experts say that this amendment was created in 1810 to prohibit anyone receiving "a title or nobility bestowed by a foreign power" to hold office.
This was originally proposed to prevent Napoleon's nephew, the French leader, from running for political power. Many speculated that Napoleon's brother would run for office after he married Elizabeth Patterson, an American socialite.
It's a centuries old amendment, which was technically never ratified. However, amendments don't expire so some wonder if it will be revived by the duchess of Cambridge if she announces a 2024 presidential campaign. Although Markle has not officially stated her intentions to run for office in any official capacity, Tom Bower, a biographer, has said that the possibility of a presidential campaign is "possible" and even "likely."
Markle's Political Efforts
Markle's political activities in recent weeks only fuel this fire. In an effort to influence the $1.75 trillion infrastructure plan, the duchess made paid parental leave her cause and called senators. In an open letter, she also addressed Nancy Pelosi, House Speaker, and Chuck Schumer, pleading for the plan to become a 'national rights'.
Bower stated that Britain has a strong tradition of keeping the royals out of politics. This is why Bower believes this is more intrusive than any royal could do in Britain. "Meeting with senators in order to lobby for a bill is the way she injects herself into US politics.
Some accuse the duchess that she uses her title in an inappropriate manner. Some politicians she spoke to said she introduced herself as the Duchess Of Sussex. Many see this as a political tactic to support the notion that she is running for president. Others claim she is entitled to the title duchess of Sussex, as it is her legal name. She changed it in 2018 when she married Prince Harry.
Can she legally run?
Experts in constitutional law say there is no reason she cannot run for the presidency as her title, even though there isn't precedent. It would retain 12 votes that it received in 1810 but it would require 26 states to ratify the amendment before it could become law.
Although Markle has not yet made any official statements about whether she is interested in a political run, many people hope to see her name on the ballot sometime in the future. We will all have to wait to see her plans.
