Brian E. Mason said in bodycam video, "I'm here for my own safety," He called it an accident, but he was charged for murder.
A bodycam video from the Miamisburg Police Department captures the moment that an Ohio man confessed to shooting and killing his girlfriend.
On March 23, the incident was captured on video. The officer is seen getting out of his car as Brian E. Mason (58), approaches him, holding a water bottle.
He says calmly, "Hello, I'm here for my own safety." "I had an accident last evening. I was showing an old friend how to use the gun she requested, when it shot her in her chest. "I've been running scared all day."
Mason said he understood why he was being placed in handcuffs and was detained by the officer. Mason said, "I wouldn’t be here voluntarily," but Mason explained that he was scared. Mason then added that a second officer arrived to assist Mason in identifying the victim and to locate her location so they could help her.
He said that he was walking in the correct direction because he knew it was the right thing to do, and that the victim was "deceased". Before he was taken into an interview room, he said that "She collapsed immediately and I became scared".
Mason was left behind by one officer, and Mason's other officer went to Mason's car to retrieve the gun. After being fully briefed, another officer arrived and exclaimed, "Oh my God!" After being filled in on everything, the original cop told him that he had said that the gun he used in her death was in his car. He then added, in air quotes: "Accidentally."
Mason provided additional information about the victim's location in the interview room before being dispatched to a home for a welfare check.
"Upon arrival of deputies they received no reply. According to a release from the Miami County Sheriff's Office, blood was seen in the residence when they looked through a window. "Forced entry was made and an adult female was discovered dead in the residence from what appeared to have been a gunshot injury."
"Detectives arrived on the scene and started the investigation. Mason was also interviewed by detectives who responded to the Miamisburg Police Department. They continued to identify the victim as Michelle L. Elliott (57), who lived at the Montgomery County Line Road address." "Miami County Corner Doctor Ginn ordered that Ms. Elliott's remains be taken to the Montgomery County Coroner's Office in preparation for an autopsy."
Mason was later indicted for murder and pleaded not guilty at his March 28 hearing. His bond was set at $1,000,000.
According to an affidavit obtained from the Dayton Daily News Mason stated that the victim wanted a "different firearm to have at her home because she felt unsafe." He also claimed that Mason panicked and covered her body in a blanket before leaving the house.
